Terms of service

Brandaddy is a service of Impact84 UG (haftungsbeschränkt), Kinzigstraße 41, 10247 Berlin, Germany (“we”). These terms apply to all use of brandaddy.app and to each purchase of credits.

Brandaddy compares a name that you enter with trademark registers, app stores, domain registries and social platforms, and shows the matches that it finds. It can also suggest names and repeat a check each day (a monitor).

This is a screening tool, not legal advice. Before you commit to a name, have a trademark attorney run a full search.

A report shows what our sources returned at the time of the check. The sources can be incomplete or out of date, and a report can miss a conflict. A report with no strong match is not a statement that you can use or register a name.

You can run a quick check without an account. To buy and use credits, you sign in with a Google account. You are responsible for the use of your account.

Paid functions are paid with credits. The Credits page shows the packs, their prices and the number of credits each function uses. Before a function uses credits, the page shows the number and asks you to confirm.

If a paid function cannot give its result, we return the credits for that function to your balance.

You cannot exchange credits for money or move them to a different account.

Stripe processes all payments. We do not receive or store your card data. Your contract for a credit pack starts when Stripe confirms the payment.

If you are a consumer, you can withdraw from a purchase of credits during 14 days after the purchase. No reason is necessary. To withdraw, write to support@brandaddy.app or use the contact form.

If no credit from the pack was used, we refund the full price. When you use a credit, you ask us to start the service before the 14 days end. For a pack that is used in part, we do not give a refund.

A monitor repeats the selected checks each day and sends an email when it finds a change. You pay for a monitor in credits for each period of 30 days. At the end of a period, the monitor renews from your balance. If the balance is too low, the monitor pauses and we tell you by email.

Do not use automated tools to read the service in bulk, do not go around the limits on free checks, and do not sell reports as your own search product. We can block an account that does this.

We are liable without limit for intent and gross negligence, for injury to life, body or health, and where the law makes liability mandatory.

For slight negligence we are liable only if we breach a duty that is essential to the contract. In that case our liability is limited to the damage that is typical and that could be foreseen. We are not liable for a decision that you make about a name on the basis of a report.

We can change the service and these terms for the future. If a change is to your disadvantage, we tell account holders by email before it applies.

German law applies. If you are a consumer in the European Union, the mandatory consumer protection rules of your country of residence continue to apply.
